Terms of Service
These Terms govern access to Advotecate, including social features, paid political advertising, donation tools, and organization accounts.
Last updated:
Welcome to Advotecate. These Terms of Service ("Terms") govern your use of the Advotecate website, platform, mobile applications, messaging tools, fundraising tools, advertising tools, and related services (collectively, the "Service") provided by Advotecate, LLC ("Advotecate," "we," "us," or "our").
By accessing or using the Service, you agree to these Terms. Your use of certain features is also subject to other applicable policies and third-party terms, including our Privacy Policy, Community Guidelines, Trust & Safety Hub, and any order form, campaign onboarding flow, checkout disclosure, or feature-specific terms presented to you. If there is a conflict between these Terms and a signed order form or other written commercial agreement with Advotecate, the signed agreement controls for the purchased Service.

1. Scope and Acceptance
The Service includes consumer-facing experiences, organization dashboards, social and civic publishing tools, advertising tools, fundraising tools, messaging workflows, analytics, and related support services. If you do not agree to these Terms, you may not use the Service.
We may update the Service from time to time, and some features may require additional onboarding, verification, or approval before use.
2. Eligibility and Authority
You must be at least 18 years old and able to enter into a binding contract to use the Service. If you access or use the Service on behalf of an organization, campaign, PAC, nonprofit, or other entity, you represent and warrant that you are authorized to bind that entity to these Terms.
When you set up an organization, we ask you to confirm that authority by checking an authorization statement, and to confirm who owns or controls the organization. Checking a box or clicking a button to agree, certify, or authorize is your electronic signature and has the same effect as a handwritten one. We keep a record of each such agreement, including the statement and its version, the time, your IP address, an approximate location, and your device information, as described in the Privacy Policy, and may rely on it as evidence of your agreement and authority.
You are responsible for ensuring that your use of the Service is lawful in each jurisdiction where you operate, solicit donations, place ads, or contact recipients.
3. Accounts, Security, and Acceptable Use
You are responsible for maintaining accurate account information, safeguarding your credentials, and all activity that occurs under your account. You must promptly notify us if you suspect unauthorized access or misuse.
You may not use the Service to:
- Violate law, regulation, court order, or binding platform policy.
- Harass, threaten, impersonate, defraud, dox, or exploit other users.
- Submit false, deceptive, or materially misleading political, fundraising, or advertising content.
- Misuse voter files, donor data, consumer data, or personal data without authorization.
- Use bots, scripts, scraping, or other automated means to access the Service without our authorization.
- Interfere with platform security, integrity, availability, or lawful civic participation.
- Facilitate unlawful political contributions, illegal fundraising, sanctions evasion, or other fraudulent activity.
We may investigate suspected misconduct and may remove content, place holds, suspend features, or terminate accounts where reasonably necessary to protect users, comply with law, prevent abuse, or manage platform risk.
4. Subscriptions, Recurring Billing, Cancellation, and Refunds
If you purchase a paid plan, add-on, or other subscription directly from Advotecate, you authorize Advotecate and its payment processor to charge the payment method you provide for the amounts, cadence, and renewal term disclosed at checkout, in your account, or in an order form.
Unless expressly stated otherwise in the applicable order form or checkout flow, paid subscriptions automatically renew for successive monthly or annual periods until canceled. You may cancel before the next renewal through your account billing settings, by following the cancellation instructions provided with the subscription, or by contacting [email protected]. Cancellation stops future renewals but does not retroactively cancel charges already incurred, and access may continue through the end of the then-current billing period unless your order form states otherwise.
Except where required by law or expressly stated by Advotecate in writing, subscription fees and other fees paid directly to Advotecate are non-refundable, and prepaid amounts are not prorated. If we change pricing for a recurring subscription, we will provide notice before the change applies to a future renewal.
If your commercial agreement with Advotecate includes minimum-term commitments, setup fees, or early termination fees, those terms are governed by the applicable order form or contract.
5. Payments, Fundraising, Donations, and Submerchant Responsibilities
Payment processing services for donations, event ticketing, payouts, and related fundraising activities are provided by third-party provider Moov Financial ("Moov"). Donors and purchasers using Moov for personal, family, or household purposes agree to the Moov Consumer User Terms. Organizations, campaigns, PACs, nonprofits, and other business users establishing or using a Moov account agree to the Moov Platform Agreement and applicable Commercial User Terms. All payment users are also subject to the Moov Privacy Policy. Applicable processor terms are presented during the relevant payment or account-onboarding flow.
Organizations, campaigns, PACs, nonprofits, and other entities that raise funds through the Service are responsible for their own fundraising pages, solicitations, donor disclosures, recipient information, chargebacks, refund decisions, payout instructions, and compliance obligations. Where Advotecate charges platform, processing, payout, or subscription-related fees, those fees will be disclosed in the applicable pricing page, checkout flow, onboarding flow, order form, or payout settings.
Advotecate provides the technology layer for transactions, but the underlying donation or purchase is generally between the donor or purchaser and the recipient organization. Recipient-specific terms, refund terms, and legally required disclosures may also apply.
6. Campaign Finance and Compliance Tools
Advotecate may provide donor attestation, contribution tracking, receipts, reporting support, and other campaign finance or compliance-oriented features ("Compliance Features"). These tools are designed to help with administration and workflow, not to replace legal, tax, accounting, or compliance advice.
The Compliance Features are provided for informational and operational assistance only and are offered "AS IS." Advotecate is not a law firm, accounting firm, registered campaign finance consultant, or government agency.
You remain solely responsible for ensuring that your fundraising, spending, reporting, advertising, disclaimers, registrations, and recordkeeping comply with all applicable federal, state, and local laws and regulations.
7. Messaging, Twilio, and Telephone Compliance
Advotecate integrates with Twilio and related carriers to support texting, calling, and messaging workflows. By using any SMS, voice, dialing, or messaging features, you agree to the Twilio Terms of Service and to comply with all applicable telecommunications and marketing laws.
- You must obtain and maintain all required consents before sending marketing texts or calls.
- You must clearly identify the organization or program responsible for the outreach and keep evidence of consent and the disclosures shown when consent was obtained.
- You must comply with do-not-call, opt-out, sender identification, quiet-hours, and record-retention requirements.
- You must complete and maintain required A2P 10DLC, short code, toll-free, or other carrier registrations before use.
- You are responsible for the content, timing, targeting, and lawful basis of your outreach.
- You will defend and indemnify Advotecate for third-party claims, fines, or losses arising from your unlawful messaging activity.
Consumer SMS Program Terms
By providing your phone number and opting in to receive SMS messages from Advotecate, you consent to receive recurring automated text messages from Advotecate regarding platform updates, waitlist status, and account notifications. Your consent is not a condition of purchase.
- Message Frequency: Message frequency varies. You may receive up to 10 messages per month depending on your account activity and preferences.
- Message & Data Rates: Standard message and data rates may apply. Check with your mobile carrier for details.
- Opt-Out: You can opt out at any time by replying STOP, QUIT, END, REVOKE, OPT OUT, CANCEL, or UNSUBSCRIBE, or through any other reasonable method that clearly communicates your request. We may send one confirmation message and will honor the request within the time required by law. The scope of an opt-out may depend on the program and whether a message is legally exempt from consent requirements.
- Help: For help, reply HELP to any message or contact us at [email protected].
- Supported Carriers: Major U.S. carriers are supported. Advotecate is not responsible for delayed or undelivered messages due to carrier issues.
- No Sharing: We will not sell, rent, or share your phone number or opt-in data with third parties for marketing purposes.
7A. Email Communications
Advotecate sends account, transactional, and marketing email and allows organizations to send email through the Service. Commercial email must use accurate sender information and subject lines, include legally required identification and postal information, provide a clear method to stop future marketing email, and honor opt-out requests within the time required by law.
Organizations are responsible for the lawful source, content, audience, and classification of their email, including whether a message is commercial, transactional, political, or otherwise regulated. They must maintain suppression lists and may not use Advotecate to contact a person who has validly opted out of the applicable sender's messages.
7B. Cookies and Tracking Choices
Advotecate uses strictly necessary cookies to sign you in, secure your session, and process donations. Analytics and marketing technologies are optional and load only after you grant the relevant category. Your choice is recorded once and applies to advotecate.com, Advotecate donation pages, and the organizer dashboard, and we will ask again when we materially change what those categories cover. No advertising or session-replay technology runs on a donation checkout page, whatever choice you have made.
We also record how you arrived, to measure outreach and report to the organizations we serve. Without an analytics allowance we keep only a classification of the arrival channel; with one we additionally keep campaign link parameters, advertising click identifiers, the referring domain, and the general shape of the landing page. The categories, what each covers, what is retained, for how long, and how to exercise your rights are described in the Privacy Policy, which governs in the event of any conflict with this section. We save your progress while you set up your account or organization, including the steps you view, complete, or skip, so you can resume and so we can remind you about unfinished setup; this is part of operating the Service.
8. User Content, Feedback, and DMCA Notices
You retain ownership of content you submit, post, upload, or transmit through the Service. You grant Advotecate a worldwide, non-exclusive, royalty-free, sublicensable license to host, reproduce, display, distribute, modify for formatting purposes, and otherwise use that content as reasonably necessary to operate, secure, improve, moderate, and provide the Service, including through contracted service providers. The license continues only for as long as reasonably necessary for those purposes, except for content you made public, copies retained by other users, backups, legal holds, and records we must preserve. We do not use your content to train a general public AI model unless we provide separate notice and obtain any consent required by law.
If you send us suggestions, feedback, or product ideas, you grant us a non-exclusive, perpetual, irrevocable, royalty-free license to use them without restriction or obligation.
If you believe content on the Service infringes your copyright, send a notice to [email protected] and include: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and where it is located; (c) your address, phone number, and email address; (d) a statement that you have a good-faith belief the use is unauthorized; (e) a statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner; and (f) your physical or electronic signature. You may also send written notices to the mailing address listed below.
9. Advotecate Intellectual Property
The Service, including our software, designs, branding, interfaces, and content other than user-submitted content, is owned by Advotecate or its licensors and is protected by intellectual property and other laws. Except as expressly permitted by these Terms, you may not copy, reverse engineer, distribute, sell, lease, or create derivative works from the Service.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADVOTECATE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
ADVOTECATE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR LEGALLY SUFFICIENT FOR YOUR SPECIFIC USE CASE, FILINGS, FUNDRAISING, OR OUTREACH.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADVOTECATE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, OR REGULATORY PENALTIES ARISING OUT OF OR RELATED TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ADVOTECATE'S AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID DIRECTLY TO ADVOTECATE FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100.
12. Dispute Resolution, Arbitration, and Class Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHT TO SUE IN COURT AND TO PARTICIPATE IN A CLASS ACTION.
- Informal Resolution First: Before filing a claim, the parties will try to resolve the dispute informally. A party starting a dispute must send written notice describing the claim and requested relief, and the parties will attempt to resolve the matter for 30 days before formal proceedings begin.
- Binding Arbitration: Except for qualifying small claims matters, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by the American Arbitration Association under its applicable consumer or commercial rules, as appropriate. The Federal Arbitration Act governs the interpretation and enforcement of this section.
- Forum: Unless the parties agree otherwise or AAA rules allow a remote proceeding, arbitration will take place in Sugar Land, Texas.
- Small Claims Carve-Out: Either party may bring an individual claim in small claims court if the claim qualifies and remains on an individual basis.
- Class Action Waiver: YOU AND ADVOTECATE AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLASS MEMBER, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
- Governing Law: These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules, except where federal law requires otherwise.
13. General Terms
We may update these Terms from time to time. If we make a material change, we may provide notice through the Service, by email, or by another reasonable method. The updated Terms become effective when posted or on the date stated in the notice. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
We may modify, suspend, or discontinue all or part of the Service at any time. We are not responsible for delays or failures caused by events outside our reasonable control, including network failures, third-party service outages, carrier actions, payment processor interruptions, labor disputes, disasters, or governmental actions.
If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our prior written consent. Sections that by their nature should survive termination, including payment obligations, intellectual property, disclaimers, limitations of liability, dispute resolution, and indemnity obligations, will survive.
