Donation and Fundraising Terms
Rules for donors, recipients, organizations, and fundraising activity on Advotecate.
Last updated:
1. Scope
These Terms apply to candidate fundraising, PAC fundraising, charitable fundraising, recurring donations, peer-to-peer fundraising, and other donation flows made available through Advotecate.
2. Donor Responsibilities
By making a donation through Advotecate, you represent that:
- The information you provide is accurate and complete.
- You are legally permitted to make the donation.
- The funds are your own lawful funds and are not being provided for reimbursement by another person.
- You will provide any legally required certifications or disclosures requested at checkout.
Certifications, contribution limits, source restrictions, and required donor information vary by recipient, election, and jurisdiction. A certification displayed at checkout applies only to the identified recipient and transaction.
3. Recipient and Organization Responsibilities
Organizations, campaigns, PACs, nonprofits, and other recipients must:
- Be authorized to solicit and receive funds.
- Provide accurate onboarding, identity, and payout information.
- Comply with applicable campaign-finance, charitable-solicitation, tax, and consumer-protection laws.
- Ensure fundraising pages are truthful and not misleading.
- Cooperate with verification, underwriting, fraud review, or legal-compliance requests.
- Identify, cure, redesignate, reattribute, return, or refund excessive, prohibited, or otherwise impermissible contributions within the time required by applicable law.
- Maintain every charitable-solicitation registration, exemption, and disclosure required in each jurisdiction where they solicit funds.
4. Charitable Giving and Taxes
An organization's presence or verification on Advotecate is not a determination that a donation is tax deductible. Recipients must state their tax status and whether a payment is deductible, and must provide any receipt or substantiation required by law. Deductibility may depend on the recipient, the donor, the purpose of the payment, and whether the donor receives goods or services in return. Donors should consult their own tax advisers.
5. Recurring Donations
Before a recurring donation is authorized, checkout will identify the donation amount, frequency, recipient, and how to cancel. A donor may cancel an active recurring donation through the donor's account or another cancellation method shown at checkout or in the donation confirmation. Cancellation stops future scheduled donations after it is processed; it does not ordinarily refund donations already processed. Recurring donations are not subscriptions to Advotecate software.
6. Fees, Tips, and Refunds
Checkout will disclose the donation amount, any separate voluntary tip to Advotecate, and the total amount charged. A tip to Advotecate is separate from the donation and is not paid to the recipient. Processing, platform, payout, or other recipient fees may reduce the amount the recipient receives when disclosed in the applicable pricing, checkout, onboarding, or payout flow.
Donors may request a refund from the recipient or through the support method shown in their receipt. Refund eligibility is generally decided by the recipient, subject to applicable law, payment-network rules, chargebacks, and mandatory return of impermissible contributions. Refunds may be partial, may take time to appear, and ordinarily return to the original payment method. The treatment of fees and separate Advotecate tips will be disclosed with the applicable transaction or refund process.
7. Holds, Reversals, and Review
Advotecate and its payment partners may hold, delay, reverse, or refuse transactions where reasonably necessary to address fraud, abuse, sanctions, chargebacks, disputes, legal compliance, or recipient eligibility concerns.
8. Payment Processing
Payment processing may be handled by third-party providers. Additional transaction-specific disclosures, processor terms, or recipient-specific certifications may be shown during checkout or onboarding and become part of the applicable terms for that transaction.
